"Selecting and refining AI-generated output requires enough creative judgment to constitute authorship." because it's a tricky area to be in, i wouldn't agree if we talk about selecting pre produced AI work but if an art director with a low budget chooses to take flat images and then uses AI to enhance it or change the setting I think i would agree simply because for an art director their vision, editing skills, theme and over arching idea is what their skillset is not actually taking the picture. Now in the same scenario if a photographer claims that image to be theirs i would disagree because their skillset is to actually take the picture, ensure the lighting is correct, the product (if any) is the subject. So this answer feels very situational on who is claiming what kind of creative work as their own
